Mediation
Initiating the Mediation

Typically, an employment mediator is hired jointly
by the parties involved in a dispute, and the parties
must agree and approve the choice. Please let me
know whether you would like my help in obtaining
the other party’s agreement to mediation. Once the
parties agree to mediate, contact me to discuss
rates, preferred dates, locations, and any other pre-
mediation issues.
Location
I can provide a neutral location or mediate at a
location selected by the parties, such as one of their
offices.
Because of the COVID-19 pandemic and the need for
social distancing, most mediations are currently
conducted by videoconference (such as Zoom). I am
available to conduct in-person mediations, if all
parties agree, depending on current health
guidelines. As we move toward the “new normal”
and resuming face-to-face mediation, my foremost
priority is the safety of all parties.
Confidentiality
All communications before, during, and after the
mediation are confidential. I will provide all parties,
their counsel, the mediator, and other participants
with a written confidentiality agreement to sign at
the start of the mediation.
Who Should Attend
All parties necessary to reach a legally binding
settlement should participate.
Follow-up
For any cases that do not settle on the day
of mediation, I will provide reasonable
follow-up through phone and/or e-mail to
help work through any lingering issues.
Briefs
Briefs should be submitted one week
before the mediation and should include:
(1) the facts of the case, (2) legal claims,
(3) procedural background, and (4) prior
settlement discussions.
